Nothing in these Terms removes rights that cannot legally be limited under Canadian law.

02 / WELLNESS INFORMATION

Medical and Wellness Disclaimer

Our tests, reports, website content, and support materials are provided for informational, educational, and general wellness purposes only.

They are not intended to diagnose, treat, cure, or prevent a disease, disorder, or medical condition. They do not replace medical testing, clinical diagnosis, treatment, or advice from a qualified healthcare professional.

Genetic information represents only one factor that may influence health and wellness. Environmental, medical, behavioural, lifestyle, family-history, and other factors may also be relevant.

Do not begin, stop, or change medication, supplements, treatment, diet, exercise, or another healthcare practice solely because of information in a report. Consult an appropriately qualified healthcare professional before making decisions that may affect your health.

Our website and services are not intended for medical emergencies. Contact emergency services or an appropriate healthcare provider if you believe you are experiencing a medical emergency.

03 / ELIGIBILITY

Who May Use the Services

To place an order or create an account, you must:

  • Have reached the age of majority in your province or territory of residence
  • Have the legal capacity to enter into a binding agreement
  • Provide accurate, current, and complete information
  • Provide a valid Canadian delivery address unless otherwise agreed
Testing a minor

A parent or legal guardian may order a test for a minor where permitted by law. The adult placing the order must have legal authority to consent to collection, processing, and analysis of the minor’s sample and to receive the minor’s report.

We may decline, suspend, or cancel an order where reasonably necessary because of incomplete information, suspected fraud, consent concerns, legal restrictions, product availability, safety concerns, or misuse of the services.

05 / ORDERS

Orders and Acceptance

Placing an order is an offer to purchase the selected product or service. An order is accepted when we send an order confirmation, begin preparing or dispatching the kit, or otherwise begin providing the service.

Products and services are subject to availability. We may limit quantities, discontinue products, or change service providers where reasonably necessary.

We may correct obvious pricing, description, availability, or technical errors. If an error affects a paid order, we will contact you with the available options. If we cancel an order before providing the service, the amount paid for the cancelled item will be refunded.

06 / PAYMENT

Prices, Taxes, and Payment

Prices are shown in Canadian dollars unless otherwise stated. Applicable taxes, shipping charges, optional services, and other fees will be displayed during checkout or communicated before payment.

Payment is due when the order is placed unless another arrangement is confirmed in writing.

You authorize us and our payment processor to charge the payment method provided for the amount shown at checkout. Payment information may be processed by independent payment providers under their own terms and privacy practices.

Please contact us before initiating a payment dispute or chargeback so that we have an opportunity to investigate and address the issue.

Important Testing Limitations
Before You Submit a Sample

Genetic testing has practical and scientific limits

Results depend on the sample received, the information provided, the markers included in the selected test, and the methodology available when the analysis is completed.

No guaranteed outcome: A report does not guarantee a particular health status, response, benefit, or future condition.
Sample quality matters: Insufficient, contaminated, damaged, or incorrectly collected samples may not produce a result.
Interpretations may change: Scientific understanding, databases, and reporting standards may develop over time.
Professional advice matters: Medical decisions should be made with an appropriately qualified healthcare professional.
07 / SHIPPING AND DELIVERY

Shipping and Delivery

Delivery and processing timeframes are estimates and are not guaranteed. Delivery may be affected by destination, weather, carrier operations, postal disruptions, holidays, public emergencies, or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address and contact information. Additional shipping charges may apply when an order must be resent because incorrect or incomplete information was supplied.

Contact us promptly if a kit arrives damaged, contains incorrect or missing materials, or does not arrive within the expected timeframe.

Sample-return instructions may vary by test. Use the return address and directions supplied with your current kit. Sending a sample to an incorrect address may cause delay, deterioration, loss, or additional expense.

08 / SAMPLE COLLECTION

Sample Collection and Quality

You must carefully follow the collection, labelling, packaging, storage, and return instructions provided with the kit.

A sample may be unsuitable because of
  • Insufficient biological material
  • Contamination
  • Incorrect collection or packaging
  • Incorrect or missing participant information
  • Damage or deterioration during transport
  • Failure to follow preparation or collection instructions
  • A technical or biological limitation affecting analysis

If a sample cannot be processed, we may request a replacement. Additional kit, administration, collection, or shipping charges may apply when the failure resulted from collection, packaging, transport, incorrect information, or another circumstance outside the laboratory’s control.

When testing cannot be completed because of a confirmed laboratory error, we may arrange appropriate repeat testing or another reasonable remedy without an additional laboratory testing charge.

09 / LABORATORY PROCESSING

Processing and Turnaround Times

Testing may be performed by independent third-party laboratories selected for the applicable product. Different products may be processed by different laboratories or service providers.

Published turnaround times generally begin after the appropriate laboratory receives an acceptable sample and all required information, documentation, and payment.

Processing may take longer when a sample requires quality review, recollection, repeat analysis, consent verification, additional information, or specialized handling.

We do not guarantee that every submitted sample will produce a complete or conclusive result. Genetic testing has technical and scientific limitations, and some findings may not be reportable.

10 / REPORTS

Reports and Results

Reports are normally delivered electronically using the email address, account, or portal associated with the order.

You are responsible for keeping your contact information current and protecting access to your email account, portal, password, and downloaded report.

Reports are based on the sample received, the information provided, the markers included in the selected test, and the methodology available at the time of analysis.

Scientific understanding, reference databases, interpretation methods, and reporting standards may change. A report reflects the interpretation available when it was prepared.

Contact us promptly if you believe a report contains an administrative error. Questions requiring medical interpretation should be directed to an appropriately qualified healthcare professional.

11 / PRIVACY

Privacy and Genetic Information

We collect, use, disclose, retain, protect, and dispose of personal and genetic information as described in our Privacy Policy.

Information may be disclosed to laboratories, cloud and technology providers, payment processors, shipping providers, customer-support providers, professional advisers, and other service providers where reasonably necessary to operate the website, fulfil an order, process a sample, deliver a report, provide support, prevent fraud, protect security, or comply with legal obligations.

We do not sell or rent personal or genetic information for commercial use.

You may request access to or correction of your personal information. You may also request deletion or withdraw consent, subject to applicable legal, regulatory, security, contractual, technical, laboratory, and record-retention requirements.

Physical samples and information generated from testing may have different retention periods. Withdrawing consent after testing has begun may not reverse processing already completed and may prevent completion of the service.

12 / CANCELLATIONS, RETURNS AND REFUNDS

When an order may qualify for a refund

Contact us as soon as possible if you wish to cancel or change an order. A cancellation is not effective until we confirm it.

Eligible Unopened Kits

An unopened, unused, sealed, complete, and undamaged kit may qualify for a refund when the return is authorized in advance and completed within 14 days of purchase.

  • Contact support before sending the kit back
  • Follow the current return instructions
  • Return the complete kit in its original condition
  • Use a trackable return method when possible
  • Keep proof of return until delivery is confirmed

Opened or Processed Kits

Unless required by applicable law, refunds are not available after a kit has been opened, used, damaged, submitted with a sample, or entered into laboratory or report processing.

  • The kit has been opened or used
  • Collection materials are missing or damaged
  • A sample has been submitted
  • Laboratory processing has started or finished
  • The kit was damaged after delivery
Return costs and refund processing

The customer is responsible for the cost and risk of return shipping. Original shipping charges are not refundable. Approved refunds are normally issued to the original payment method after the returned kit is received and inspected. Your bank, card issuer, or payment provider may require additional time to post the funds.

Contact us promptly if you receive a damaged, incomplete, or incorrect kit. Depending on the circumstances, we may provide replacement materials, reship the order, correct the order, or provide another appropriate remedy.

Nothing in this section limits a refund, cancellation right, warranty, or remedy that cannot lawfully be limited under applicable consumer protection legislation.

13 / INTELLECTUAL PROPERTY

Personal Use and Intellectual Property

The website and its content—including text, graphics, designs, software, photographs, videos, product names, reports, and trademarks—are owned by or licensed to us and are protected by applicable intellectual-property laws.

  • Scrape, harvest, or systematically extract website content or data
  • Reverse engineer or interfere with website software or security
  • Use our content to create a competing commercial product or service
14 / ACCEPTABLE USE

Acceptable Use

You must not use the website or services:

  • For an unlawful, fraudulent, deceptive, harmful, or unauthorized purpose
  • To submit a sample without the required consent or legal authority
  • To impersonate another person or provide false participant information
  • To access another customer’s account, order, sample information, or report
  • To transmit malware or interfere with website, portal, network, or security systems
  • To reproduce, resell, or commercially exploit the services without permission
  • In a manner that violates another person’s privacy, confidentiality, intellectual property, or legal rights
15 / THIRD-PARTY SERVICES

Third-Party Services and Links

Our services may rely on or link to independent laboratories, payment processors, shipping providers, portals, cloud platforms, healthcare resources, or other third parties.

Third parties may have their own terms, privacy policies, operating procedures, and service limitations.

We are not responsible for independent third-party websites or services that are not under our control, except to the extent required by applicable law.

16 / SERVICE AVAILABILITY

Disclaimer of Warranties

To the maximum extent permitted by law, the website and services are provided on an “as available” basis.

We do not guarantee that the website, portal, laboratory process, delivery service, or report will always be uninterrupted, error-free, available by a specific date, or suitable for every individual purpose.

We do not guarantee a particular wellness outcome, medical outcome, interpretation, recommendation, or benefit from using a test or report.

Nothing in these Terms excludes a warranty, condition, guarantee, or consumer right that cannot legally be excluded.

17 / LIABILITY

Limitation of Liability

To the maximum extent permitted by applicable law, we are not responsible for indirect, incidental, special, exemplary, punitive, or consequential losses arising from the use of or inability to use the website, kit, report, or services.

To the maximum extent permitted by law, we are not responsible for losses resulting from:

  • Medical, dietary, supplement, treatment, or lifestyle decisions made without appropriate professional advice
  • Incorrect, incomplete, or misleading information supplied by a customer or participant
  • Unauthorized submission of another person’s sample
  • Failure to follow collection, packaging, shipping, or security instructions
  • Loss, contamination, deterioration, or delay caused by a postal or courier provider
  • A sample that does not produce sufficient or conclusive information
  • Unauthorized access caused by failure to protect account or email credentials
  • Events outside our reasonable control

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, or another liability that cannot lawfully be excluded or limited. Nothing limits mandatory Canadian consumer-protection or privacy rights.

18 / EVENTS OUTSIDE OUR CONTROL

Events Outside Our Reasonable Control

We are not responsible for a delay or failure caused by circumstances outside our reasonable control, including postal or courier disruption, severe weather, natural disaster, fire, flood, power or internet failure, labour disruption, public-health emergency, government action, supply shortage, laboratory interruption, cyber incident, or telecommunications failure.

Where reasonably possible, we will take appropriate steps to reduce the effect of a disruption and resume the affected service.

19 / SUSPENSION OR TERMINATION

Suspension or Termination

We may suspend or terminate access to the website, an account, or a service where reasonably necessary to address a breach of these Terms, suspected fraud, unauthorized sample submission, a security threat, abusive conduct, non-payment, or a legal or regulatory requirement.

Suspension or termination does not affect rights, obligations, payments, or liabilities that arose before the effective date of suspension or termination.

20 / CHANGES TO THESE TERMS

Changes to These Terms

We may update these Terms to reflect changes to services, business practices, technology, or legal obligations.

Updated Terms will be posted on this page with a revised “Last updated” date. Where reasonably appropriate, we may also provide notice by email, through the website, or through an account or portal.

Changes apply from the stated effective date and will not retroactively remove rights that have already arisen unless permitted or required by law.

21 / GOVERNING LAW

Governing Law and Disputes

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles.

This provision does not deprive you of a mandatory protection available under the laws of the province or territory in which you reside.

Before beginning formal proceedings, you and MethylationTest.ca agree to make a reasonable effort to resolve the matter by contacting the other party and providing relevant details.

Subject to a mandatory consumer right to bring a claim in another jurisdiction, disputes may be brought before a court of competent jurisdiction in British Columbia.

Nothing in these Terms requires a consumer to waive the right to bring a claim before a court, participate in a class proceeding, or use another remedy available under applicable law.

22 / GENERAL PROVISIONS

General Provisions

These Terms, together with the Privacy Policy, Shipping, Sample Return & Refund Policy, order confirmation, product description, and any additional terms presented for a specific service, form the agreement between you and us concerning the applicable service.

If a provision is found to be invalid or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.

A failure or delay in enforcing a provision does not waive the right to enforce it later.

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights or obligations as part of a corporate reorganization, financing, merger, sale, or transfer of the relevant business, subject to applicable privacy and consumer-protection requirements.

Headings are included for convenience and do not affect interpretation.
